Claim of an Irish homosexual concerning legislation prohibiting homosexual acts. Although the applicant had not been convicted for violation of the said legislation the Court held that the applicant could claim to be a victim of a violation of the Convention on the mere fact of running the risk to be affected by the said legislation. With regard to the right of respect of his private life (article 8 of the Convention) the Court found that there was no pressing social need to lay down far-reaching restrictions with regard to voluntary homosexual acts between adults. Consequently there was a violation of article 8 of the Convention.
